
Women under the bus – Roe is finished
a) STATE OPT-OUT OF ABORTION COVERAGE.– ”(1) IN GENERAL.–A State may elect to prohibit abortion coverage in qualified health plans offered through an Exchange in such State if such State enacts a law to provide for such prohibition.
In other words, states may override women’s right to chose. Bye Roe! 










I was worried when I read about Boxer meeting with Nelson. Thanks Obama!

On Tuesday afternoon, Senate Democrats decided not to sell out women, even if doing so would make passing health-care reform easier. By defeating the Nelson amendment, they finally demonstrated some respect for the feminists who are a crucial part of the Democratic Party. The fact is, the old, purely class-based New Deal coalition isn’t feasible in the 21st century. Women’s rights can no longer be blithely traded away at the bargaining table.

The abortion compromise seems to allow states the power to prohibit abortion coverage within the new insurance exchanges. In other words, it sounds like giving each state the right to enact its own version of the Stupak amendment that the House bill would apply nationally.

NYT uses the verb “clinch” (as in “clinching the primaries) which we know is always bad news
Mr. Reid’s amendment includes major restrictions on abortion that were intended to win support for the bill from Mr. Nelson. Under Mr. Reid’s proposal, health insurance plans are not required or forbidden to cover abortion services, but there is a major exemption that would give states power to prohibit abortion coverage in the insurance markets, or exchanges, where most health plans would be sold.

Only principled woman? GOP Olympia Snowe
Senator Olympia J. Snowe, a Maine Republican who had been considered a possible Democratic ally, said she would oppose the measure, saying it was being rushed through.
Another entertaining upcome: GOP is unhappy with Nelson caving in. According to Tapper entry on facebook they say
..He had a chance to be a hero for taxpayers and the unborn and instead it turns out he’s nothing but a huckster whose vote was for sale”
Update 2 – the promise that it won’t be undone
As I read of dreams of signature statements and reconciliation to undo Nelson’s turd, Ezra Klein makes it clear
Nelson also secured a promise that his compromises would not be undone. He has been guaranteed “a limited conference between the Senate and the House.” That is to say, the bill will not change much when the House gets a crack at it.

When I got the news, I e-mailed NOW. Terry O’Neal didn’t disappoint
“The so-called health care reform bill now before the Senate, with the addition of Majority Leader Harry Reid’s Manager’s Amendment, amounts to a health insurance bill for half the population and a sweeping anti-abortion law for the rest of us,” NOW President Terry O’Neill said in a statement.
“We call on all senators who consider themselves friends of women’s rights to reject the Manager’s Amendment, and if it remains, to defeat this cruelly over-compromised legislation,” O’Neill added.”

I’m so damned depressed. Not only did they give away my rights, but they’re going to fine me if I can’t afford to buy into the damned thing.
Senators Barbara Boxer and Patty Murray bless Nelson’s compromise in a joint statement:
“We said all along that we wanted to ensure there was a firewall between private and public funds — this compromise achieves that.
“We said we would not accept language that prohibited a woman from using her own private funds for her legal reproductive health care — this compromise meets that test.
“And we said we would stop Stupak — which we did. Let’s be clear — we were both much happier with the Capps language and the language in the underlying bill.
“But compromise was necessary to get a health care bill for the American people, and this compromise achieves that.”

Stupak isn’t giving up btw. Politico’s reporting that he’s working with Catholic bishops & the GOP to over turn the compromise.
Obama’s even more diabolical than I thought:
The insurance industry wants this bill badly, and big pharma likes it too.
Here’s why:
California will probably pass single payer on its own in 2011. All they need is a Democratic Governor. The legislature has already passed the bill. Schwarzenegger vetoed it. Once California has single-payer, most (if not all) states will follow suit.
It’s likely that if we pass a new law now, the new law will preempt single-payer, i.e. the Federal law will preempt state law and prevent states from enacting a single-payer system.
THIS is what the health insurance companies fear. THIS is what brought them to the bargaining table. THIS is why they are not fighting Obama’s tepid reforms, and THIS is why it is extremely important that we do not pass any health insurance reform bill this year.
Let’s not settle for a bail-out of the health insurance industry. Let’s insist on the eradication of it. In all likelihood, California will lead the way in 2011 … if we can just give them time.
Canada got its single-payer system one province at a time, and it looks like that’s the only way it can happen in the United States.

A. I am actively supporting Fiorina against Boxer. Boxer may be in trouble already and that may deepen.
B. Anyone who thinks that CA is a shoo in to elect a Dem governor does not know the politics of this state or its economic condition and political attitude at this time.
CA gave you Ronnie Raygun, the John Birch Society and some real right wingers. The sad residue of CA’s once liberal politics is that moderate and progressive Republicans simply do not exist any more in this state. So when the pendulum swings the other way, as it always does, you don’t get Earl Warren and Thomas Kuchel, you get Raygun and modern day Birchers.

‘‘(c) PROTECTION OF SECOND AMENDMENT GUN RIGHTS.—
‘‘(1) WELLNESS AND PREVENTION PROGRAMS.—A wellness and health promotion activity implemented under subsection (a)(1)(D) may not require the disclosure or collection of any information relating to—
‘‘(A) the presence or storage of a lawfully-possessed firearm or ammunition in the residence or on the property of an individual; or
‘‘(B) the lawful use, possession, or storage of a firearm or ammunition by an individual. [p. 5]
It goes on for another page and a half about what the feds can’t do vis-a-vis your precious guns. Too bad the founders didn’t create a specific amendment that gave women as much protection for their uteruses as their guns.
